84.         Requiring businesses to provide complete product information to customers 6 T% U$ ?( G4 M3 J8 J5 @; D
promotes various consumer interests, but at the same time imposes burdens on
% L+ m6 f' j& {5 v" M& B" \businesses, government, and taxpayers. On balance, the burdens outweigh the benefits,
7 b  W$ {. w0 r/ U( rat least in most cases.
  d8 j! r2 a, Q- U; S      A threshold problem with disclosure requirements is that of determining what 7 ~# g" z9 t* c* K
constitutes "complete" information. Admittedly, legislating disclosure requirements ; j( L0 j/ r, ]3 C* i1 @
clarifies the duties of business and the rights of consumers. Yet determining what
3 [0 `' m; s% Prequirements are fair in all cases is problematic. Should it suffice to list ingredients,
! T# t2 ?3 `& {- h% dinstructions, and intended uses, or should customers also be informed of precise
( M' |" U4 @3 Z0 @8 Jspecifications, potential risks, and results of tests measuring a product's effectiveness
( H" ?  G: L, u; t% Jvis-a-vis competing products? A closely related problem is that determining and ) c3 J; e' P8 T! T4 a- A$ C; T
enforcing disclosure standards necessarily involves government regulation, thereby 5 \$ l/ ]" O: f
adding to the ultimate cost to the consumer by way of higher taxes. Finally, failure to
! }3 Z9 |" I+ O$ p) l6 |comply may result in regulatory fines, a cost that may either have a chilling effect on
7 u( q2 l# l+ _1 i- D8 `product innovation or be passed on to the customers in the form of higher prices. Either ) K9 y; l  h4 L( B  F, F
result operates to the detriment of the consumer, the very party whom the regulations " i6 Y$ [/ O# \1 ^$ i% ]& l
are designed to protect.
  K& Z9 l% d0 H8 T( E7 G/ ^) i! `0 G  l      These burdens must be weighed against the interest in protecting consumers & g3 ]. t( C% L8 c  q& {
against fraud and undue health and safety hazards. To assume that businesses will
4 f1 \3 Q* p& B6 _6 evoluntarily disclose negative product information ignores the fact that businesses are
4 @* W+ Y: ^( H9 L- `' Q. ?motivated by profit, not by public interest concerns. However, consumers today have ! E( i. {+ ~( z* I3 q
ready access to many consumer-protection resources, and may not need the protection ' [- C7 ]* j. ~7 M: Z8 E1 g
of government regulation. Although health and safety concerns are especially
% X* s+ V7 g1 K, V2 V( \- qcompelling in the case of products that are inherently dangerous—power tools,
% f! W. T' K/ g6 F( orecreational equipment, and the like—or new and relatively untested products, * B2 A) i3 p& ]
especially pharmaceuticals, narrow exceptions can always be carved out for these
" S* |1 N! r8 t) mproducts.
8 D: o1 K& w8 a& K+ Y      In conclusion, while stringent disclosure requirements may be appropriate for
, Z! M+ q5 Y  ]% xcertain products, businesses and consumers alike are generally better off without the
8 ]" G5 y; N2 k2 M; Zburdens imposed by requiring that businesses provide complete product information to ' c# v4 t/ I% Y' q1 z
all customers.
