41.         Imposing heavy penalties on those who pollute or destroy the environment is one
. W- k' e) n" x; jway to preserve our environment. But it is not the only way; nor is it the best way.
/ l& w8 n! Z6 Q9 `" tPenalties may elicit grudging compliance, but other approaches—those that instill a ) u5 u) S1 X4 t0 q* V
sense of genuine commitment—are likely to be more effective in the long term.4 A. d+ D% \0 Y6 [+ c  I
      Admittedly, motivating compliance with environmental regulations by way of 2 S' T) t6 V% g5 x& y
penalties will serve environmental goals up to a point. The deterrent effect of these ! y$ [; u% a* V( h3 A- P+ i. r
remedies cannot be denied. Yet it should not be overstated. Some businesses may
0 @8 ]0 J2 b9 n9 B/ l  jattempt to avoid punishment by concealing their activities, bribing (lobbying) legislators - v: N# A+ b  i4 r
to modify regulations, or moving operations to jurisdictions that allow their
! K/ o3 J/ k, ?3 }' Eenvironmentally harmful activities. Others might calculate the trade-off between 5 d! W1 i/ Y0 A3 {8 \. e+ l
accepting punishment and polluting, budget in advance for anticipated penalties, then 8 E8 {. s) r; d+ O
openly violate the law. My intuition is that this practice is a standard operating mode
" q6 _3 ~' h" c4 W# ]0 h' S$ qamong some of our largest manufacturers.
- X# T. S2 z7 q5 P, E$ C, q      A better way to ensure environmental protection is to inculcate a sense of genuine , k: `& R5 n" n0 [! E2 W
commitment into our corporate culture—through education and through shareholder 4 K1 @& L) }  t. ~
involvement. When key corporate executives become committed to values, the / d7 |0 N6 v/ f1 c
regulations associated with those values become a codification of conscience rather than - t5 _* e/ |4 y2 q% i
obstacles to circumvent. The machinations and maneuverings described earlier will $ Z/ y  ~9 U! E& Y2 R# ]
thereby be supplanted by thoughtful concern about all the implications of one's actions.
8 F( @# P# t) ^0 X& N" ~# VMoreover, commitment-driven actions are likely to benefit the environment over and & x& o6 E2 c! S$ \
above what the law requires. For example, while a particular regulation might permit a , P/ g8 q8 D0 \) G% D1 _, Z
certain amount of toxic effluents, businesses committed to environmental protection . w' l( v' m7 O! d, _! g
may avoid harmful emissions altogether.' P4 c: g1 a2 }! c* f# l- O4 F+ P" i
      Instilling a genuine sense of commitment through education and shareholder ' B6 C/ [1 ~5 G- L& w4 V
action is not just a better approach in theory, it is also less costly overall than a
( Y7 q6 g6 [: z5 a+ Acompliance-driven approach. Regulatory systems inherently call for legislative
8 n" A4 Y) s4 y  H1 G3 S! r8 i. d( ccommittees, investigations and enforcement agencies, all of which adds to the tax
$ `1 n; A/ Y+ ]' z. lburden of the citizens whom these regulations are designed to protect. Also, delays 2 ]- @" W7 q' G% B1 ^
typically associated with bureaucratic regulation may thwart the purpose of the & l9 r$ B  e% I9 K
regulations, since environmental problems can quickly become very grave.. D0 S  K0 Z4 e2 i$ s' A3 |6 J- k
      In sum, penalties for violating environmental-protection laws are essentially
( n. |. A2 P  H0 J  ^expensive band-aids. A commitment-based approach, involving education and 1 h: e' g1 C: m8 w7 l1 a% P
shareholder activism, can instill in corporate culture a sense an environmental
4 ~. y: @2 ^, [( m9 ?conscience, resulting in far more effective environmental protection.
